Terms and Conditions
These Terms and Conditions form a legally binding agreement between you (the patient/client) and Mediglo Clinic, with its primary place of business at [Insert Full Address], Gurgaon, Haryana, India.
They apply to all Services (as defined below) provided by Mediglo and are intended to:
- Clarify your rights and responsibilities
- Ensure transparency about pricing, booking, cancellation, and treatments
- Comply with Indian consumer protection and healthcare regulations
1. Definitions and Interpretation
1.1 The following expressions shall have the meanings given:
- “Clinic”, “We”, “Us”, “Our” refers to Mediglo Clinic, including its doctors, staff, and authorized agents.
- “You”, “Your” refers to the individual receiving services from Mediglo Clinic.
- “Services” means any clinical or cosmetic treatments, consultations, diagnostics, wellness sessions, or products provided by the Clinic, including but not limited to skincare, laser treatments, injectables, hair restoration, wellness, and longevity therapies.
- “Consumer” means an individual receiving services for personal use and not for business or resale purposes.
1.2 Headings are for convenience only and do not affect interpretation.
1.3 Words in the singular include the plural and vice versa.
1.4 References to gender apply to all genders.
2. Appointments and Booking
2.1 All services are available strictly by appointment. You can book in person, via phone, WhatsApp, email, or our website.
2.2 Your booking request is an offer. A legally binding contract is formed only when we confirm your appointment.
2.3 We may require a deposit of 25% of the treatment fee when booking. This deposit may be retained if you cancel without adequate notice.
2.4 We do not guarantee any specific date/time unless your appointment is confirmed.
2.5 If you are more than 30 minutes late, we may treat the appointment as cancelled without notice. This may result in loss of your deposit.
2.6 You can cancel an appointment without penalty if you provide at least 48 hours’ notice. Any prepaid deposit will be fully refunded.
2.7 If you cancel with less than 48 hours’ notice, we reserve the right to retain up to 50% of the treatment fee.
2.8 In special cases (such as illness, accident, or bereavement), we may waive late cancellation fees at our discretion.
2.9 We may cancel your appointment under these circumstances:
- Unavailability of key staff or equipment
- Events beyond our control (e.g., electricity outage, public emergency)
- If you are found not to be a “Consumer” under these terms
You will be entitled to a full refund of any advance payments in such cases.
2.10 If your treatment start time is delayed by more than 30 minutes and you choose not to wait, you may request a full refund or reschedule.
2.11 Under the Indian Consumer Protection (E-Commerce) Rules, 2020, you may cancel a service within 14 days of online booking, unless the service has already been delivered or begun.
3. Fees and Payment
3.1 You must pay the full amount due for the services upon completion unless otherwise agreed in advance.
3.2 We accept:
- Credit/Debit Card
- UPI/QR Payments
- Net Banking
- Cash
- Clinic Gift Vouchers (see Section 6)
3.3 Prices may change without prior notice. However, once your appointment is confirmed, any price change will not apply to you.
3.4 All listed prices are inclusive of applicable GST or other taxes.
4. Eligibility for Treatment
4.1 You confirm that you are a Consumer using services for personal purposes.
4.2 Treatments may only be provided to individuals aged 16 and above. For those under 18, written parental or guardian consent is required.
4.3 You must inform us of any known medical conditions, allergies, medications, or ongoing treatments before receiving services.
4.4 If you fail to disclose relevant health information, we may cancel the appointment and retain cancellation charges.
4.5 For certain services, such as laser or chemical peels, a patch test may be required at least 24 hours in advance.
4.6 We advise against waxing or facials before or after exercise or heat-based treatments.
4.7 Pregnant individuals should avoid certain therapies (e.g. aromatherapy or laser) in the first trimester. Always consult your doctor before booking.
5. Clinic Rules
To ensure a safe and respectful environment:
5.1 Mobile phone calls are not permitted inside treatment areas.
5.2 Children under 10 must be supervised and are not allowed in clinical areas.
5.3 Disruptive, abusive, or inappropriate behavior may result in denied service or removal from premises.
6. Gift Vouchers
6.1 Gift vouchers are available in denominations or for specific services.
6.2 Vouchers are valid for 6 to 12 months, as stated on the card.
6.3 They are non-refundable and not redeemable for cash.
6.4 Lost or expired vouchers cannot be reissued.
7. Limitation of Liability
7.1 We are responsible for foreseeable damage or loss directly caused by our negligence
7.2 We are not liable for:
- Unforeseen side effects from treatments undertaken against advice
- Delays due to factors outside our control
- Loss of income, profit, or commercial opportunity
- Reactions due to incomplete medical disclosure
7.3 Nothing in this document limits our liability for death or personal injury due to proven negligence.
8. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. The latest version will always be available at the Clinic and on our website.
9. How We Use Your Personal Information
We handle your personal data in accordance with our Privacy Policy, which complies with:
- The Information Technology Act, 2000
- The SPDI Rules, 2011 (Sensitive Personal Data or Information)
Your information is used only to provide care, improve services, and communicate with you. You may request to access or delete your data at any time.
10. Regulatory Compliance
We adhere to all relevant Indian health and consumer protection laws including:
- Consumer Protection Act, 2019
- Drugs and Cosmetics Act, 1940 (where applicable)
- Clinical Establishments Act (if applicable in your region)
We ensure transparency, consent, and professional care in every interaction.
11. Information Disclosure
All pre-treatment information, consent requirements, risks, and expectations will be clearly explained before service delivery. You have the right to ask questions and seek clarifications before consenting.
12. No Waiver
Failure to enforce any part of these Terms does not mean we waive our rights to do so in the future.
13. Severability
If any clause of this agreement is found invalid, the rest of the document remains in effect.
14. Governing Law and Jurisdiction
14.1 These Terms shall be governed by the laws of India.
14.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Gurgaon, Haryana.
14.3 You retain all consumer protection rights as per applicable Indian law.
